1. GENERAL DISPOSITIONS

The general dispositions of this page regulate the rights and duties of both the company Bayona Petit Tradex Consulting S.L., owner of the domain www.climamarket.eu (from her on, Climamarket) and the user (customer).

It is required, in order to place orders through our website www.climamarket.eu, to accept the general dispositions established below.

These general dispositions may be modified by Climamarket, at any time and without the obligation of previous notice. The only valid conditions will be those stated in this page.

Once you have made a purchase through our website www.climamarket.eu, we consider that you are aware of and accept these terms and conditions, with these being in full effect, unless derogated by Climamarket.

2. PURCHASING PROCESS

The customer may place orders through our website as long as they have previously signed up formally.

Orders may be placed via website or e-mail sending a message to admin@climamarket.eu. Accepted orders are strictly restricted to goods and services listed in our site. No deals will be sealed through phone.

Online 24/7 Store:

The fastest and most comfortable way to place an order is through our web store, allowing customers to make their purchases any time of the day, any day of the year.

E-mail ordering:

If the customer prefers to order through our mail, their salesman will help them satisfactorily finish their purchase. Our customer service schedule is 10.00h to 14:00h and 16:00h. to 20.00h.

Purchase confirmation.

Once the order is placed, the customer will receive a confirmation mail from Climamarket in the e-mail address they used to sign up. If the customer has not received this confirmation within 24 hours they must contact Climamarket.

3. ORDER REVOCATION

Confirmed purchases can not be undone in the following scenarios:

When 3 days have passed since the customer received our confirmation.

When the goods have been sent.

Climamarket have the right to revoke orders yet to be sent if the customer has partially or completely reneged on past contracts.

4. PRICE AND SHIPPING

The customer will get access to our deals and promotions through our website.

Climamarket have the right to change prices at any time and without previous notice. Despite this, confirmed purchases will remain unaltered.

If any mistakes were found in the placed orders, we will contact the customer before proceeding with the shipping of the goods.

Delivery conditions and freight costs

Delivery is free for any orders placed within peninsular Spain. All products in our store are shown with their final price included, V.A.T and freight costs included.

For all orders outside the peninsula and abroad, our system calculates freight costs automatically through the purchasing process. If you want more information about our freight costs click here.

Orders will be sent once Climamarket has received the corresponding payment. Under no circumstances will orders be sent before receiving said payment.

Climamarket will not accept delivering at particular times of the day. All deliveries will be carried out within commercial hours.

Installing conditions

The end user agreed to provide proof to Climamarket that the installation of the equipment will be undertaken by a capable and authorised company and installer. With that in mind, Climamarket will send the customer two documents: FORM A, in which the end user is informed that they are obligated to make sure that the installation is performed by a qualified professional that is legally allowed

FORM B will be returned to Climamarket once the installation is finished, as testimony that the installation has been performed by an authorised company and installer.

5. ORDER RECEPTION

Product availability, and therefor arrival times, may vary depending on the quantity, brand and model requested.

When the customer signs the dispatch note copy, the purchase has been confirmed.

If the product received by the client does not coincide with the requested one, or the product was damaged, they must indicate it in the dispatch note immediately after reception and communicate it to Climamarket.

If the product was damaged and it could not be noticed on arrival, the customer must contact Climamarket immediately through our e-mail admin@climamarket.eu

6. PAYMENT CONDITIONS

Payment of purchases from Climamarket must be paid for upfront.

The goods are property of Climamarket until the payment has been finalised.

7. RETURNS

The customer has the right of withdrawal, which they can enforce within 14 days after the product has been received. Climamarket will accept the use of this right as long as the product has not been installed, altered or is not lacking any accessories or pieces.

8. WARRANTY

Climamarket answers for the flaws and defects that manifest within two years since the delivery.

Through said period, the supplier must proceed accordingly with the repairing, substitution, price drop or contract release. These procedures will come at no extra cost to the customer. The customer must inform the supplier about any disconformity within two months since they were aware of it.

Warranty is valid in all countries annexed to the European Union.

Warranty will not cover any malfunctions that are the result of incorrect or unlawful manipulation, repairing and installation of the product or any other circumstance unrelated to Climamarket.

9. TAXES

Overall, all taxes applied on Climamarket goods will be assumed by the customer.

10. APPLICABLE LEGISLATION AND JURISDICTION

These Terms and Conditions are regulated by Spanish Law. The parties will be subjected, on their own accord, to the courts and tribunals of the user's residence for conflict resolution. Moreover, as an entity adhered to 'Confianza Online' and according to the terms of it Ethic Code, in the occurrence of controversies related to online contracting and marketing, data protection and minor protection, the user can make use of the extrajudicial resolution system of 'Confianza Online': www.confianzaonline.es
